Donald Trump was acquitted in the New York criminal trial after the judge asked him “God have mercy” in the 2nd term.

Trump called the case and his verdict “a huge setback for the American judicial system.”

“This is a great shame for the state of New York,” Trump said, adding that people had seen the trial with their own eyes and voted “definitely” for him to be elected president.

Merchan did not sentence the president-elect to prison and instead sentenced him to unconditional release, meaning no punishment — no jail time, fines or probation. The ruling also preserves Trump’s ability to appeal the ruling.

“After careful analysis, this court has determined that the only statutory sentence that allows this sentence to be entered is a conditional discharge,” Merchan said Friday. “Currently, I set that punishment to cover all 34 articles.”

Merchan added: “Sir, I wish you the best of luck as you complete your second term.”

Merchan said last week when he was scheduled for sentencing that he would “not impose any prison sentence,” but instead imposed a sentence of “unconditional release,” meaning there would be no sentence.

Trump filed an appeal to prevent the ruling from advancing to the New York State Court of Appeals. That court rejected his petition.

Trump also filed an emergency petition with the US Supreme Court, claiming it “immediately ordered a stay of criminal proceedings pending in the Supreme Court of the District of New York, New York.”

“The motion to recuse Justice Sotomayor, which she referred to the Court, is denied, inter alia, for the following reasons,” the high court said.

TRUMP RESPECTS SUPREME COURT’S REJECTION OF VERDICT, SAYS WILL APPEAL

“First, President-elect Trump’s alleged evidentiary violations in state court are normally amenable to appeal,” the Supreme Court ruled Thursday evening. The President-elect’s obligations are relatively insignificant in light of the trial court’s decision to impose a sentence of unconditional release after a brief virtual hearing.”

The order also stated that “Justice Thomas, Justice Alito, Justice Gorsuch and Justice Kavanaugh will grant the petition.”

Trump needed five votes to fulfill his request. A note in the order said Chief Justice John Roberts and Justice Amy Coney Barrett joined Justices Sonia Sotomayor, Elena Kagan and Katanji Brown Jackson in the vote.

Trump will be sworn in as the 47th president of the United States on January 20.

Trump has maintained his innocence in the case and has repeatedly spoken out against it as an example of “legislation” being pushed by Democrats to undermine their election efforts ahead of November.
