December 23 a press release confirmed that special prosecutor Kari Morrissey has dropped an appeal she filed Nov. 21 seeking to reinstate criminal charges against Baldwin, which a judge had already dismissed.

The press release states that “the special counsel intended to appeal the dismissal, however the Attorney General’s Office advised the special counsel that the Attorney General did not intend to pursue an appeal exhaustively on behalf of the prosecution.”

The state insisted it “strongly disagrees” with the court’s decision to drop Baldwin’s manslaughter charge and denied concealing the evidence that ultimately led to the dismissal.

“This has always been about finding justice for Galina Hutchins,” Morrissey said in a statement, according to the release. “We regret that Mr. Baldwin will not be prosecuted for the role he played in the death of Galina Hutchins and we are withdrawing the appeal, we do so in the hope that the pending legal proceedings will bring some measure of justice to the family of Galina Hutchins.”

In their own statement released on Christmas Eve, Baldwin’s legal team said: “Yesterday’s decision to dismiss the appeal is the ultimate confirmation of what Alec Baldwin and his lawyers have been saying from the beginning – this was an unspeakable tragedy, but Alec Baldwin committed no crime . The rule of law remains intact in New Mexico.”
