Accused Jay-Z’s rape lawsuit is too old to proceed, lawyer says

Jay-Z is trying a different approach after the judge ruled that a woman is suing him can remain anonymous.
According to Rolling Stone and Deadlinerap mogul’s lawyer, Alex Spirofiled new documents on Monday, December 30, in an attempt to challenge lawsuit accusing Jay-Z of rape because the alleged assault is said to have taken place months before the civil legal aid for victims of gender-based violence law came into effect in December 2000. In December 2022, the New York City Council amended the law to give people a two-year window to come forward with historic claims that would otherwise be time-barred.
“Plaintiff cannot recover on her sole claim under the GMV Act as a matter of law because the statute is non-retroactive,” Spiro wrote in a letter to Judge Annalisa Torreson time.
He continued: “The plaintiff alleges a violation of the GMV Act for conduct that allegedly occurred in September 2000. But the GMV Act was not enacted until December 19, 2000, three months after the FAC alleges the conduct took place, and cannot be applied retroactively to create a cause of action unavailable to the plaintiff at the time in question “.
In the lawsuit filed earlier this month, Jay-Z’s accuser, identified only as “Jane Doe,” stated that she was raped rapper and fellow musician Sean “Diddy” Combs at the 2000 MTV Video Music Awards. She said she was 13 at the time. (Both Jay-Z and Diddy deny the allegations.)
Last week, Judge Torres court documents say TMZ has learned that Jane Doe may remain unnamed after Jay-Z’s lawyer filed a statement case closed and Doe’s identity revealed. However, the judge noted that circumstances may change as the case progresses. Torres said she intends to revisit the matter if and when the case progresses.
Torres also accused Spiro of being belligerent and trying to “speed up” the case.
Lawyer Tony Busbyrepresenting Doe, said in a statement to Us Weekly“I usually do not comment on court decisions. I will say that the concerted and desperate attempt to attack me as an advocate for the alleged victims is failing.”
Busby and Jay-Z are also involved in their legal battle. Jay-Z — real name Shawn Carter — is suing Busby, accusing him of extortion and defamation. Busby filed his own lawsuit against Jay-Z’s Roc Nation earlier this month, claiming the company bribed clients to file lawsuits against his firm, threatened former clients and impersonated government officials. (Rock Nation is called a “fool’s” lawsuit.)
